BHGR’s Appellate Group attorneys have over 150 years of collective experience arguing appeals in state appellate courts, the Federal Courts of Appeal, and the United States Supreme Court.
BHGR’s Appellate Group represents individuals, partnerships, emerging companies, established small and mid-size businesses, corporations, Fortune 500 Companies, Global Fortune 500 Companies, and public entities at all levels of appeal. We assist our clients with preserving issues for appeal at the trial court level, obtaining appellate review while matters are pending in the trial court, and appealing or defending appeals after final judgment has entered in the trial court.

Preservation of Issues for Appeal
An effective appeal begins with proper preservation of the issues for appeal at the trial court level. We assist our clients with significant trial motions, jury instructions, and post-trial motions to assist them in preserving critical issues for appeal.
C.R.C.P. 54(b) Certification, Interlocutory Appeals, & Original Jurisdiction
Some cases call for appellate review prior to final judgment in the trial court. Our attorneys have successfully obtained C.R.C.P. 54(b) certification, utilized interlocutory appeal statutes and rules, and convinced the Colorado Supreme Court to exercise its original jurisdiction under C.A.R. 21.
Notices of Appeal and Petitions for Certiorari
Our attorneys have filed countless notices of appeal with the lower state and Federal appellate courts and petitioned for and been granted certiorari by the Colorado Supreme Court. We have also successfully defended against petitions for certiorari in the Colorado Supreme Court and the United States Supreme Court.
Appellate Briefing
Our group is adept at drafting and filing opening, response, and reply briefs, following strict court standards and requirements. We have repeatedly succeeded in obtaining reversals and defending judgments on appeal.
Oral Argument
Our attorneys have made oral arguments to the Colorado Court of Appeals, Supreme Court of Colorado, Ninth Circuit Court of Appeals, Tenth Circuit Court of Appeals, and United States Supreme Court.

BHGR’s Appellate Group also works with attorneys at other firms who seek appellate consulting services, advice, and moot court opportunities.
Our Approach
Our appellate attorneys come from large national firms, local private practices, and government attorneys’ offices. Several of our attorneys clerked for state or Federal appellate judges before working in private practice, giving them behind-the-scenes insight into the inner workings of the appellate courts.
