Contracting & Preconstruction

We assist clients with preconstruction services, including entity creation and corporate governance, bonding, insurance review and selection, and risk identification and management. Our attorneys also negotiate, draft, and review all types of construction contracts, including purchase orders, EPCs, design-build, design-bid-build, CMAR, and concession and development contracts, as well as drop-down and lower-tier subcontracts, frameworks, financing, joint ventures, master services, secondment, and supply agreements.

Contract Administration, Claims Avoidance, & Mid-Performance Disputes

During the construction process, we assist clients with a multitude of contract performance and administration issues. Our attorneys negotiate, draft, and review change orders. We also help our clients address differing site conditions, project delays and impacts, payment disputes, requests for equitable adjustments, warranty work, mechanics’ liens, and terminations. Our team prepares claim submissions and engages in the economical and prompt resolution of mid-performance claims and disputes. We also provide training sessions for our client’s executives and employees to avoid risk and effectively manage issues as they arise during project execution.

Government Contracting

From proposal drafting through the successful conclusion of projects, our attorneys have considerable experience representing contractors in all phases of government contracting with federal, state, regional, and local authorities.

Mediation & Arbitration

Our attorneys have extensive experience in alternative dispute resolution forums. We have represented clients in front of single arbitrators as well as arbitration panels in local, national, and international arbitrations before organizations such as the AAA Construction Panel, AAA Construction Mega Project Panel, and ICC. Some of our attorneys serve as arbitrators for the AAA Construction and/or the AAA Construction Mega Project Panels, giving them unique insight into the arbitration process and best arbitration practices. All our attorneys also have experience guiding clients through the mediation process.

Our attorneys are powerful advocates with extensive experience representing construction clients in state and federal courts in a broad range of disputes, including those concerning: acceleration; bid protests; bonds; breaches of contract; CDARA; change orders; commercial construction defects; delays; design defects; disruptions; equitable adjustments; indemnities; insurance; loss of productivity; mechanics’ liens; residential construction defects; sureties; terminations; and warranties.
