One-sided construction contracts have become the norm, frequently leading to disputes instead of identifying and shifting risk while simultaneously facilitating a successful project.

In this session, we will review the key provisions in every construction contract (including scope of work, flow-down, change orders, forced account, notice provisions, payment, pay-if-paid, inspection rights, audit rights, warranty, indemnity, limitations of liability, LDs, confidentiality, protection of IP, and differing site conditions) and discuss ways to effectively manage risk across the project stakeholders while protecting your rights at the same time.

Projects can fall apart due to numerous issues, but the main reason is a lack of proper and timely communication and a lack of collaboration.  

In this session, you will hear about ways to protect yourself if the project starts having issues, including preparing proper notices, maintaining accurate job cost reports that include claim-related cost codes, preparing proper project reports (including minutes, schedule narratives, daily reports, timesheets, notes, etc.), and what to say – and not say – in emails, reports and text messages (yes, text messages are discoverable).

January 2024

This session will provide lessons learned from arbitration professionals, including arbitrators, counsel, experts, and project executives, on how to successfully prepare for and win your arbitration proceeding. 

In this session, you will hear about strategies for effectively presenting evidence that matters to arbitrators and trial courts and what to avoid when presenting your case.
